Terms of Service for Wilmek Property Management

This Agreement is made by and between Wilmek Construction LLC ("Wilmek", "Contractor") and the customer purchasing services ("Owner" or "User").

1. General Terms

The Owner and Contractor commit to at all times cooperate fully with each other and proceed on the basis of good faith to permit each party to realize the benefits afforded under this Agreement.

2. Services

Wilmek Property Management provides the following services:

  • Property management and oversight
  • Resident placement and screening
  • Rent collection and financial reporting
  • Maintenance coordination and oversight
  • Legal compliance and eviction support
  • Marketing and listing of rental properties

3. Owner Responsibilities

Owner shall throughout the performance of this Agreement, cooperate with Wilmek. Owner shall perform its responsibilities, obligations, and services in a timely manner so as not to delay or interfere with Wilmek's performance of its obligations under this Agreement.

4. Compensation & Payment

Payments due and unpaid by Owner to Wilmek shall bear interest commencing five (5) days after payment is due at the rate of eighteen percent (18%) per annum, and such rate shall continue to apply post judgment until such time as all sums due Wilmek are paid in full.

5. Dispute Resolution

In the event Owner believes that Wilmek has defaulted under this Agreement, Owner must provide Wilmek written notice of the default within forty-eight (48) hours of the default. The parties agree that any claim, dispute or controversy arising out of or relating to this contract that cannot be resolved through discussions shall be submitted to non-binding mediation.

Florida Law shall be applied in adjudicating any dispute. Venue for any such mediation or arbitration shall be in Ocala, Florida.

6. Limitation of Liability

The Owner and Wilmek waive claims against each other for consequential damages arising out of or relating to this Agreement.

7. Governing Law

This Agreement shall be governed by the laws of the State of Florida, without giving effect to its conflict of law principles.
